5. Scope of Service
Ghost provides an AI-powered recruitment platform that connects Candidates with Employers. Our Services include:
- AI-powered interviews with Candidates to assess skills, experience, and career goals
- Generation of candidate assessments, fit scores, and profile summaries
- Matching Candidates with relevant job opportunities
- Facilitating Introductions between Candidates and Employers
- Employer tools for managing recruitment processes
5.1 No Guarantee of Outcomes
Important: While we strive to deliver high-quality matches and assessments, we cannot and do not guarantee any specific outcomes. Specifically:
- For Candidates: We cannot guarantee that you will receive any interviews, job offers, or Engagements.
- For Employers: We cannot guarantee the accuracy, completeness, or suitability of any Candidate, or that any Candidate will accept an offer or remain in a role.
All hiring decisions are made by Employers. Ghost facilitates the recruitment process but does not make employment decisions.
5.2 Platform Availability
We will use commercially reasonable efforts to keep the Platform available and accessible. However, the Platform is provided over the internet and may occasionally be unavailable due to technical issues, maintenance, or factors beyond our reasonable control. We do not guarantee uninterrupted or error-free access to the Platform.
6. Use of AI Technology
6.1 AI-Generated Content and Assessments
Our Platform uses artificial intelligence, including large language models, to conduct interviews, generate assessments, and facilitate recruitment matching. You acknowledge and agree that:
- AI technology is evolving and may produce errors, inaccuracies, or incomplete information.
- AI-generated assessments, fit scores, rankings, and recommendations are for informational purposes only and should not be relied upon as the sole basis for any decision.
- Nothing generated by our AI constitutes professional, legal, or contractual advice.
- Salary ranges, market data, or professional guidance provided by the AI are indicative only and may be inaccurate.
You should always independently verify and assess any information provided by the Platform before acting on it.
6.2 AI Interviews and Recordings
The Platform includes AI-powered interview functionality. When participating in an AI interview:
- Your voice will be recorded and transcribed to generate candidate assessments.
- The content of your interview may be used to improve our Services, using anonymised and aggregated data.
- Interview recordings will be retained for a limited period as set out in our Privacy Policy (6 months for recordings, 24 months for transcripts).
- We do not create biometric voiceprints from voice recordings.
- We do not sell or license personal data to third parties for AI training purposes.
By using the AI interview feature, you consent to the recording and processing of your voice data as described above and in our Privacy Policy.
6.3 Automated Decision-Making
Our AI generates assessments and match scores to support recruitment decisions. However, no hiring decision is made solely on the basis of automated processing. All final recruitment decisions involve meaningful human review by the Employer. You have the right to request human intervention, express your point of view, and contest any AI-generated assessment. See Section 6 of our Privacy Policy for details.
7. Data, Privacy, and Data Sharing
7.1 Privacy Policy
Our Privacy Policy describes in detail how we collect, use, store, and protect your personal data. By using the Platform, you acknowledge that you have read and understood our Privacy Policy.
7.2 Data Controller Responsibilities
Ghost as Data Controller: Ghost Technology AB is the independent data controller (personuppgiftsansvarig) for all personal data collected and processed through the Platform, including candidate profiles, AI interview data, assessments, and platform usage data. Ghost determines the purposes and means of processing this data in accordance with the GDPR and applicable Swedish data protection legislation.
Employer as Separate Data Controller: When Ghost shares candidate data with an Employer through the Platform (an Introduction), the Employer becomes an independent data controller for that data in relation to its own recruitment purposes. The Employer determines independently how it will use the shared data for evaluating, interviewing, and potentially Engaging the Candidate.
Independent Controllers, Not Joint Controllers: Ghost and the Employer act as independent data controllers under the GDPR (not joint controllers under Article 26 GDPR). Each party is independently responsible for its own compliance with Data Protection Laws in respect of the personal data it controls.
7.3 Data Shared with Employers
When Ghost makes an Introduction, the following categories of candidate data may be shared with the Employer:
- Professional profile: name, contact details, CV/resume, work history, skills, education, and role preferences.
- AI-generated outputs: candidate assessment summaries, fit scores, rankings, and profile summaries.
Data that is never shared with Employers: Interview voice recordings, raw interview transcripts, internal platform usage data, and any Special Category Data that may have been incidentally disclosed during an AI interview are never shared with Employers.
7.4 Candidate Control Over Data Sharing
If you are a Candidate, you acknowledge and agree that by using the Platform:
- Your professional profile and AI assessment results may be shared with Employers for the purpose of facilitating recruitment.
- You can control the visibility of your profile through your account settings at any time.
- You may withdraw from data sharing by adjusting your settings or contacting us at [email protected]. Please note that restricting data sharing may limit our ability to provide certain Services to you.
7.5 Employer Obligations as Data Controller
If you are an Employer, you acknowledge and agree that upon receiving candidate data through the Platform, you become an independent data controller under the GDPR for that data. This means you are independently responsible for:
- Establishing a lawful basis for your processing of the candidate’s personal data (e.g., legitimate interest in evaluating the candidate for employment, or consent).
- Using candidate data exclusively for the purpose of evaluating the Candidate for a role within your own organisation. Any other use is strictly prohibited.
- Not disclosing, sharing, forwarding, or making available any candidate data to any third party (including other companies in your group, recruitment agencies, or any other person) without the Candidate’s express prior consent.
- Complying with all applicable Data Protection Laws, including responding to data subject access requests from Candidates and honouring their rights under Chapter III GDPR.
- Implementing appropriate technical and organisational security measures to protect candidate data against unauthorised access, loss, or destruction.
- Deleting or securely destroying all candidate data if the Candidate is not Engaged, within a reasonable period not exceeding six (6) months from the date of Introduction, unless a longer retention period is required by applicable law.
- Not using Ghost’s AI-generated assessments, fit scores, rankings, or recommendations as the sole or decisive basis for any recruitment decision, including rejection of a Candidate. In accordance with Article 22 GDPR, all decisions that produce legal effects or similarly significant effects on Candidates must involve meaningful human review — meaning a qualified person within your organisation who has genuine authority to override the AI output, access to sufficient information to make an independent assessment, and who does not routinely follow automated recommendations without independent evaluation.
- Carrying out all necessary background checks, reference checks, qualification verification, criminal record checks, and right-to-work verification before Engaging a Candidate. Ghost does not perform any such screening and accepts no liability for the accuracy or completeness of candidate-provided information.
Breach of Data Obligations: Any breach of the data protection obligations set out in this Section 7.5 shall constitute a material breach of these Terms. Ghost reserves the right to immediately suspend or terminate the Employer’s access to the Platform and to pursue all available legal remedies, including claims for damages.
7.6 Ghost’s Sub-Processors
Ghost uses third-party service providers (sub-processors) to operate the Platform. These sub-processors process personal data on Ghost’s behalf and are bound by data processing agreements in accordance with Article 28 GDPR. A list of our current sub-processors is available upon request by emailing [email protected]. Details are also set out in our Privacy Policy.
8. User Responsibilities and Acceptable Use
8.1 General Obligations
All users of the Platform agree to:
- Provide accurate, complete, and up-to-date information at all times.
- Keep login credentials confidential and not share access with others.
- Use the Platform only for its intended purposes (recruitment and job seeking).
- Comply with all applicable laws and regulations.
- Not submit false, misleading, or fraudulent information.
8.2 Prohibited Conduct
You must not:
- Engage in harassment, discrimination, hateful speech, or any offensive conduct on the Platform.
- Attempt to disrupt, damage, or compromise the security or integrity of the Platform.
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Platform.
- Use the Platform to develop, market, or distribute any competing product or service, or conduct competitive analysis.
- Use the Platform through automated means (bots, scrapers, crawlers) without our express written permission.
- Copy, reproduce, distribute, or create derivative works of the Platform or its content.
- Use any information obtained through the Platform to contact Candidates outside of the Platform for recruitment purposes without Ghost’s involvement (applies to Employers).
Violation of these rules may result in immediate suspension or termination of your account, legal action, and/or referral to the relevant authorities.
8.3 Additional Employer Obligations
Employers additionally agree to:
- Not use the Platform in the capacity of, or on behalf of, a recruitment agency, staffing firm, headhunter, or other intermediary, unless expressly authorised by Ghost in writing.
- Not share Introductions with third parties. Any unauthorised Third-Party Introduction that results in an Engagement of the Candidate shall make the Employer liable for the applicable Success Fee.
- Promptly notify Ghost of any Engagement of a Candidate within twelve (12) months of an Introduction, including disclosure of the Candidate’s compensation details (see Section 10).
- Not attempt to circumvent these Terms for the purpose of avoiding payment of any fees due to Ghost.
PART B — CANDIDATE-SPECIFIC TERMS
This Part B applies in addition to Part A if you are a Candidate using the Platform.
9. Candidate Services
9.1 Free Access
The Platform is provided to Candidates at no cost. You will never be charged any fee for using the Platform or our Services as a Candidate.
9.2 Your Profile and Interviews
As a Candidate, you will create a profile and may participate in an AI-powered interview to help us understand your experience, skills, and career goals. While completing the interview is not mandatory, it significantly improves the quality and relevance of job matches we can provide to you.
You retain ownership of all personal data and Content you provide to the Platform. By using the Platform, you grant Ghost a non-exclusive, worldwide licence to use, process, and share your Content solely for the purpose of providing our Services, including making Introductions to Employers. This licence terminates when you delete your account, subject to any data we are legally required to retain (see our Privacy Policy).
9.3 Introductions and Engagement
When we identify a potential match between you and an Employer, we may share your professional profile and assessment results with that Employer. You can control this through your account visibility settings.
If an Employer decides to proceed with your candidacy, you are under no obligation to accept any interview request or job offer. All employment decisions remain between you and the Employer. Ghost is not a party to any employment relationship.
9.4 Notification of Engagement
If you are Engaged by an Employer who was Introduced to you through the Platform, we kindly ask that you notify us within 30 days by emailing [email protected]. This helps us improve our Services and ensure the Platform remains free for all Candidates.
PART C — EMPLOYER-SPECIFIC TERMS
This Part C applies in addition to Part A if you are an Employer using the Platform.
10. Fees and Payment
10.1 Success Fee
If Ghost makes an Introduction of a Candidate and you or any of your Affiliates Engage that Candidate within twelve (12) months of the Introduction, you will pay Ghost a Success Fee.
- Success Fee (employees): the Success Fee agreed when the Employer accepts these Terms. A Success Fee is payable regardless of whether the Candidate is Engaged for the role originally discussed at the time of Introduction.
- Success Fee (contractors): the Success Fee agreed when the Employer accepts these Terms. A Success Fee is payable regardless of whether the Candidate is Engaged for the role originally discussed at the time of Introduction.
- Conversion to employee: If a Candidate Engaged as a contractor becomes your employee within twelve (12) months of the commencement of the Engagement, a Success Fee based on the employee calculation shall be payable, less any fees previously paid under the contractor Engagement.
10.2 Refund Guarantee
If a Candidate you Engage as an employee leaves the Engagement within the first three (3) months of their start date due to resignation (except where arising from misconduct or breach by the Employer) or dismissal related to performance, Ghost will provide a full refund of the Success Fee.
To be eligible for a refund, you must notify us in writing within 14 days of the termination. The refund will be processed within 30 days of notification.
10.3 Pre-Existing Candidates
A Success Fee will not be due if a Candidate was already in your active recruitment pipeline prior to our Introduction. An “active recruitment pipeline” requires evidence of substantive engagement within six (6) months prior to our Introduction, specifically:
- e) A direct application from the Candidate to you for a similar role; or
- f) Substantive, two-way communication between you and the Candidate regarding a potential role.
Internal discussions, database records, passive sourcing, or unilateral communications that did not receive a substantive response from the Candidate do not qualify.
To claim this exception, you must notify us in writing (to [email protected]) within ten (10) business days of the Introduction and provide reasonable written evidence. If you do not notify us within this timeframe, the Introduction will be deemed the effective cause of the Engagement, and the Success Fee will be payable in full.
10.4 Payment Terms
- Invoice timing: We may issue the invoice on the date the employment contract or contractor agreement is signed, or on the date we become aware of the Engagement, whichever is earlier.
- Payment period: You must pay the Success Fee within [30] days of receiving our invoice.
- Currency: Invoices will be issued in SEK or EUR, as agreed between the parties.
- Late payment: If payment is not received by the due date, interest will accrue at the rate prescribed by the Swedish Interest Act (räntelagen, SFS 1975:635), currently the reference rate plus 8 percentage points per annum.
- VAT: All fees are exclusive of VAT (moms). VAT will be added where applicable.
10.5 Disclosure Obligations
You must promptly notify Ghost if you or any Affiliate makes an offer of employment or otherwise Engages a Candidate within twelve (12) months of an Introduction. You must disclose the Candidate’s first-year base salary (for employees) or the total fees and rates payable (for contractors).
If you fail to provide complete and accurate compensation details, we reserve the right to invoice based on our reasonable estimate, which shall be binding unless proven manifestly incorrect.
10.6 Anti-Circumvention
You must not, and must ensure that your Affiliates do not, directly or indirectly circumvent these Terms for the purpose of avoiding payment of fees. If you, any Affiliate, or any related party Engages a Candidate whom we Introduced within twelve (12) months, you shall be liable for the applicable Success Fee.
11. Employer Representations and Warranties
By using the Platform as an Employer, you represent and warrant that:
- You are an end employer using the Platform solely to hire for your own internal roles, and not a recruitment agency, staffing firm, or intermediary acting on behalf of third parties.
- All information you provide about your organisation and open roles is accurate, complete, and not misleading.
- You will comply with all applicable employment and anti-discrimination laws when evaluating and Engaging Candidates.
- You are solely responsible for all hiring decisions. The Platform is powered by AI, and you must not rely on any AI-generated output without independent human review and approval. You confirm that your recruitment process includes meaningful human oversight of any AI-generated data received from Ghost, and that no Candidate will be rejected or selected solely on the basis of automated scores or assessments.
PART D — GENERAL LEGAL TERMS
This Part D applies to all users of the Platform.
12. Intellectual Property
12.1 Ghost’s Intellectual Property
All intellectual property rights in the Platform, including trademarks, copyright, database rights, design rights, and the underlying software code, are exclusively owned by Eira Technology AB and/or its licensors. Nothing in these Terms transfers any intellectual property rights to you.

12.2 Your Content
You retain all intellectual property rights in the Content you upload to or create on the Platform. By uploading Content, you grant Ghost a non-exclusive, worldwide, royalty-free licence to use, store, process, and display your Content solely for the purpose of providing and improving our Services.
We may use anonymised and aggregated data derived from your Content to improve our AI algorithms and Platform functionality. Such data will not identify you personally.
12.3 Feedback
If you provide us with feedback, suggestions, or recommendations regarding the Platform, you grant us a perpetual, irrevocable, royalty-free licence to use such feedback for any purpose without any obligation to you.
13. Confidentiality
Each party agrees to take reasonable steps to protect the confidential information of the other party received in connection with these Terms and the use of the Platform. Confidential information shall only be used for the purposes of the relationship contemplated by these Terms.
This obligation does not apply to information that: (a) is or becomes publicly available through no fault of the receiving party; (b) was already known to the receiving party; (c) is independently developed by the receiving party; or (d) is required to be disclosed by law, regulation, or court order.
14. Disclaimers
The Platform is provided “as is” and “as available”. To the fullest extent permitted by applicable law, Ghost disclaims all warranties, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and reliability.
Without limiting the foregoing, Ghost does not warrant or represent that:
- The Platform will be uninterrupted, error-free, or free of viruses or harmful components.
- Any information, assessment, or recommendation provided through the Platform will be accurate, complete, or reliable.
- Use of the Platform will result in any particular outcome, including any Engagement.
- The AI will not produce errors, inaccuracies, or unexpected outputs.
No screening of Candidates: Ghost does not carry out background checks, reference checks, qualification verification, criminal record checks, right-to-work checks, or any other screening of Candidates. Employers are solely responsible for all due diligence.
15. Limitation of Liability
15.1 Cap on Liability
To the maximum extent permitted by applicable law, Ghost’s total aggregate liability to you for all claims arising out of or in connection with these Terms and the Platform shall not exceed:
- For Employers: the total fees you have paid to Ghost in the twelve (12) months preceding the event giving rise to the claim.
- For Candidates: since the Platform is provided free of charge to Candidates, our liability shall not exceed SEK 5,000.
15.2 Exclusion of Indirect Losses
To the maximum extent permitted by applicable law, Ghost shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, business, data, or opportunity, whether or not foreseeable and regardless of the basis of liability.
15.3 Exceptions
Nothing in these Terms limits or excludes liability for:
- Death or personal injury caused by negligence.
- Fraud or fraudulent misrepresentation.
- Any other liability that cannot be limited or excluded by applicable Swedish or EU law.
16. Indemnification
16.1 Employer Indemnification
If you are an Employer, you agree to indemnify, defend, and hold harmless Ghost and its officers, directors, employees, and agents from and against all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from or related to:
- g) Your breach of these Terms;
- h) Your use of the Platform, including any Engagement of a Candidate;
- i) Your violation of any applicable law or regulation;
- j) Any third-party claims arising from your use of Candidate data.
16.2 Candidate Indemnification
If you are a Candidate, you agree to indemnify Ghost from claims arising from the submission of false, misleading, or fraudulent information through the Platform.
17. Force Majeure
Ghost shall not be liable for any failure or delay in performing our obligations under these Terms if such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, pandemics, strikes, government actions, power failures, internet disruptions, or third-party service failures.
18. Changes to These Terms
We may update these Terms from time to time to reflect changes in our Services, applicable law, or business practices. We will notify you of any material changes by email or through a prominent notice on the Platform.
If you continue to use the Platform after the updated Terms take effect, you will be deemed to have accepted the changes. If you do not agree to the updated Terms, you must stop using the Platform and close your account.
19. Assignment and Transfer
Ghost may transfer or assign its rights and obligations under these Terms to another party without your prior consent, for example, in connection with a merger, acquisition, or sale of all or substantially all of our assets. These Terms will continue to apply in full.
You may not transfer or assign any of your rights or obligations under these Terms without Ghost’s prior written consent.
20. Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced with a valid provision that achieves, to the extent possible, the intended purpose of the original provision.
21. Entire Agreement
These Terms, together with our Privacy Policy and any other documents expressly incorporated by reference, constitute the entire agreement between you and Ghost regarding your use of the Platform. They supersede all prior agreements, representations, and understandings, whether written or oral.
No content on the Platform, including informational videos, FAQ pages, or blog posts, forms part of these Terms unless expressly stated.
No binding agreements with AI: Interactions with our AI (including interview conversations) do not create any legal or contractual obligation of any kind beyond what is set out in these Terms.
22. No Waiver
If Ghost fails to exercise or enforce any right or provision of these Terms on a particular occasion, this does not constitute a waiver of such right or provision and does not prevent Ghost from exercising or enforcing it at a later date.
23. Third-Party Rights
These Terms are between you and Ghost. No third party has any rights to enforce any provision of these Terms.
24. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of Sweden, without regard to its conflict of laws principles.

Nothing in this section limits your rights as a consumer under mandatory Swedish or EU consumer protection law, including your right to bring proceedings in the courts of your habitual residence.
